The website lp.esfera.com.tr is the “data controller” for personal data under Law No. 6698 on the Protection of Personal Data and provides users with information in accordance with the relevant laws and regulations through this Information Text.

Purpose of Processing Personal Data:

Personal data of users are processed within the scope of the conditions and purposes specified in Articles 5 and 6 of Law No. 6698 for the following purposes:
– To carry out necessary work by relevant units to benefit users from the products and services offered by Esfera and to conduct related business processes.
– To conduct necessary studies and perform related business processes for commercial activities carried out by Esfera.
– To plan and execute Esfera’s commercial and/or business strategies.
– To ensure the legal, technical, and commercial business security of Esfera and related individuals in business relationships with Esfera.
– To plan and execute activities necessary for customizing and promoting Esfera’s products and services according to the preferences, usage habits, and needs of the relevant individuals.

Transfer of Personal Data:

Personal data of users may be shared with company officials, business partners, legally authorized public institutions and organizations, and private entities in accordance with the conditions and purposes of personal data processing specified in Articles 8 and 9 of the Law No. 6698 for purposes such as benefiting from the products and services offered by Esfera, carrying out necessary studies and business processes, ensuring legal, technical, and commercial security, and customizing Esfera’s products and services.

Consent of Users Regarding the Subject:

According to Article 5, Paragraph 2 of Law No. 6698, personal data can be processed without obtaining explicit consent from users in the following cases:
– If explicitly provided by laws.
– If necessary for the protection of life or physical integrity of someone unable to give consent due to physical impossibility or if legal validity of consent cannot be recognized.
– If necessary for the processing of personal data directly related to the establishment or performance of a contract.
– If mandatory for the data controller to fulfill its legal obligations.
– If made public by the data subject.
– If necessary for the establishment, exercise, or protection of a right.
– If necessary for the data controller’s legitimate interests, provided that it does not harm the fundamental rights and freedoms of the data subject.

The services provided under the Esfera membership agreement fall under the scope of Article 5, Paragraph 2(c) of Law No. 6698.

Method and Legal Basis for Collecting Personal Data:

Personal data are collected electronically from users. Collected personal data can be processed and transferred for the purposes and within the scope specified in Articles 5 and 6 of the Law and this Information Text.

Rights of Personal Data Owners:

According to Article 11 of Law No. 6698, data subjects have the right to:
– Learn whether their personal data is processed.
– Request information about their personal data if processed.
– Learn the purpose of processing personal data and whether it is used in accordance with that purpose.
– Know third parties to whom personal data is transferred, both domestically and internationally.
– Request correction of incomplete or inaccurate data and request that the correction be communicated to third parties to whom the data has been transferred.
– Request deletion or destruction of personal data if the reasons for processing no longer exist, and request that this be communicated to third parties to whom the data has been transferred.
– Object to the outcome of processing personal data solely through automated systems that results in an unfavorable consequence for the individual.
– Request compensation for damages caused by unlawful processing of personal data.
